Justice Amy Coney Barrett Confirmed by Senate

By a vote of 52-48, the U.S. Senate confirmed Justice Amy Coney Barrett to the Supreme Court. Her appointment means the court will have nine Justices present for the oral arguments in Texas v. California, the case on the severability of the individual mandate from the Affordable Care Act (ACA). In the past, Justice Barrett was critical of a decision on the ACA by Chief Justice John Roberts in NFIB v. Sebelius, as well as the decision in King v. Burwell to uphold the use of premium tax credits on the federal exchanges. Oral arguments in California v. Texas begin Nov. 10.
